TERMS OF SERVICE

These Terms of Service govern your use of the Maison T. website and every purchase you make through it. By browsing this site, creating an account or placing an order, you agree to be bound by these Terms. Please read them before you buy.
These Terms are governed by South African law, principally the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") and the Protection of Personal Information Act 4 of 2013 ("POPIA"). Nothing in these Terms limits, excludes or replaces any right you have under those Acts, and any provision that purports to do so is unenforceable to that extent.
1. WHO WE ARE
Section 43(1) of ECTA requires us to make the following information available to you before you transact:

Our full pricing, payment methods, dispatch times, security and privacy practices, and our return, exchange and refund policy are set out in these Terms and in the policies referred to in clause 9, all of which form part of our ECTA disclosures.
2. ACCEPTANCE, CAPACITY AND ELIGIBILITY
• By using this site or placing an order you confirm that you have read, understood and accepted these Terms.
• You must be 18 years or older, or have the assistance or consent of your parent or legal guardian, to enter into a binding agreement with us. If you are under 18 and order without that consent, the agreement may be void, and we may cancel and refund the order.
• You confirm that the information you give us — your name, delivery address, contact details and payment details — is accurate and complete, and that you are authorised to use the payment method you select.
• If you do not accept these Terms, please do not use the site or place an order.
3. YOUR ACCOUNT
You may browse and buy as a guest, or create an account to save your details and view your order history.
• You are responsible for keeping your password confidential and for all activity that takes place under your account. Please choose a strong password and do not share it.
• Tell us promptly at info@maisontcandles.com if you believe your account has been accessed without your permission.
• You must keep your account details current. We are not responsible for a delivery that fails because your saved address was out of date.
• You may close your account at any time from your account page, or by emailing us. Closing your account does not affect orders already placed, and we may retain records we are legally required to keep — see our Privacy Policy.
• We may suspend or close an account where we reasonably believe it is being used fraudulently, to make repeat abusive returns, to resell our products in breach of these Terms, or in breach of clause 12. Where we do so, we will tell you why, and any legitimate order already paid for will be fulfilled or refunded.
4. OUR PRODUCTS
• Our candles are hand-poured in small batches. Slight variation in colour, wax texture, surface finish, scent strength and vessel finish between items and between batches is a characteristic of the craft, not a defect.
• Product photographs are for illustration. Colours can appear differently depending on your screen, and props shown in a photograph are not included unless the description says so.
• Fragrance is subjective, and scent throw varies with room size, ventilation and temperature. A candle that doesn't smell as strong as you hoped is a change-of-mind return under our Refund & Returns Policy, not a defect.
• Weights, dimensions and stated burn times are approximate. Burn time depends on how the candle is used.
• We may change, improve or discontinue a product, fragrance or vessel at any time without notice. This does not affect an order we have already accepted.
• All products are intended for domestic, decorative use by consumers and are not supplied for commercial or industrial application.
5. CANDLE SAFETY AND RESPONSIBLE USE
[Please read before burning]
A candle is a live flame. Used carelessly, it can cause fire, injury or property damage. The instructions below, together with the safety label supplied with every product, form part of these Terms.
• Never leave a burning candle unattended, and never burn one while asleep.
• Keep burning candles out of reach of children and pets, and away from curtains, bedding, paper and anything else flammable.
• Always burn on a stable, level, heat-resistant surface, away from draughts, vents and open windows.
• Trim the wick to approximately 5 mm before every burn. An untrimmed wick causes smoking, sooting and an oversized flame.
• On the first burn, allow the wax to melt across the full surface — usually two to three hours — to prevent tunnelling.
• Do not burn for longer than four hours at a time, and allow the candle to cool fully before relighting or moving it.
• Stop burning when approximately 10 mm of wax remains. Burning below this can crack or overheat the vessel.
• Never use water to extinguish a candle, and never touch or move a vessel while the wax is molten or the glass is hot.
• Keep the wax pool free of wick trimmings, matches and debris.
• Do not repurpose a used vessel until it has fully cooled and been cleaned.
To the extent the law allows, we are not liable for loss, injury or damage caused by failure to follow these instructions or the safety label on the product. This does not limit our liability under section 61 of the CPA for harm caused by unsafe goods, a product failure, a defect or inadequate instructions or warnings — that liability cannot be excluded, and we do not attempt to exclude it.
6. PRICES AND PAYMENT
• All prices are shown in South African Rand (ZAR) and exclude VAT at the prevailing rate. Delivery is charged separately unless a free-delivery threshold applies.
• Prices may change at any time, but a change will never affect an order we have already accepted.
• Payment is taken in full at checkout. We accept [list your payment methods — e.g. Visa, Mastercard, instant EFT, PayFast, Ozow, SnapScan].
• Payments are processed by Payfast over an encrypted connection. We never see or store your full card details. As ECTA requires, we use a payment system that is sufficiently secure with reference to accepted technological standards.
• Your order is only processed once payment has cleared and passed our verification checks.
• Pricing errors. Section 23(9) of the CPA allows a supplier not to be bound by an inadvertent and obvious error in a displayed price, provided the error is corrected and you are told before the goods are supplied. If this happens we will contact you to confirm or cancel your order and will refund you in full if you choose to cancel.
• Charges levied by your own bank — currency conversion, international transaction or gateway fees — are for your account.
7. ORDERS AND WHEN A CONTRACT IS FORMED
• Your order is an offer to buy. Our automated order-confirmation email acknowledges receipt of that offer but does not accept it.
• A binding contract of sale comes into existence only when we dispatch the goods and send you a dispatch confirmation, or when we expressly accept your order in writing.
• Before you place your order, our checkout gives you the opportunity to review the whole transaction, correct any mistake and withdraw, as section 43(2) of ECTA requires. Please use it — check your items, quantities, address and contact details carefully.
• Under section 43(3) of ECTA, if we fail to give you that opportunity, you may cancel the transaction within 14 days of receiving the goods.
• Your order confirmation, invoice and these Terms are emailed to you and available in your account, so that you can access and keep a full record of the transaction.
• We may decline or cancel an order before dispatch in the circumstances set out in our Cancellation Policy, including stock shortages, pricing errors, failed payment verification and suspected fraud.
• We may limit or refuse quantities that appear intended for resale.
8. DELIVERY, RISK AND OWNERSHIP
Delivery areas, timeframes, rates, customs charges and our handling of lost or damaged parcels are set out in full in our Delivery Policy. In summary: delivery timeframes are estimates and not guarantees; risk and ownership pass to you on delivery to the address you supplied or on your collection of the goods; and international orders are shipped Delivered Duty Unpaid, so import duties and taxes are for your account.
9. RETURNS, REFUNDS AND CANCELLATION
Your rights to return goods, obtain a refund and cancel an order are set out in our Refund & Returns Policy and our Cancellation Policy, which form part of these Terms. In summary:
• ECTA gives you 7 days from delivery to cancel an online purchase without reason and without penalty, for a full refund. You bear the direct cost of returning the goods.
• We offer a further 14-day change-of-mind return window as a commercial concession.
• The CPA gives you 6 months from delivery to return defective, unsafe or unsuitable goods, and to choose a repair, replacement or refund at our cost.
• Burnt or used candles, and personalised or bespoke commissions, are excluded from change-of-mind returns.
10. INTELLECTUAL PROPERTY
• The Maison T. name, logo, product names, fragrance names, packaging design, label artwork, photography, copy and the design of this website are owned by us or licensed to us, and are protected by South African and international intellectual property law.
• You may view, download and print pages of this site for your own personal, non-commercial use.
• You may not copy, reproduce, republish, sell, adapt or use our content, imagery or branding for commercial purposes — including on marketplaces, resale listings, dropshipping stores or competing products — without our prior written permission.
• Nothing on this site grants you a licence or right to use any Maison T. trade mark.
• We are happy for you to share our product photographs on social media with credit to Maison T. That permission may be withdrawn at any time.
11. REVIEWS AND CONTENT YOU SUBMIT
• By submitting a review, photograph, comment or other content, you grant Maison T. a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and display that content in our marketing, on our website and on our social media channels, with attribution where practical.
• You confirm that the content is your own, that it is accurate, and that it does not infringe anyone else's rights or breach any law.
• We may edit for length or decline to publish content that is unlawful, defamatory, discriminatory, obscene, misleading, or that contains another person's personal information.
• We do not publish fake reviews, and we do not remove genuine negative reviews simply because they are unfavourable.
12. ACCEPTABLE USE OF THIS SITE
You agree not to:
• use the site for any unlawful, fraudulent or harmful purpose;
• introduce a virus, trojan, worm or other malicious code, or attempt to gain unauthorised access to the site, its servers or any connected system;
• scrape, harvest, mine or systematically extract data or content from the site;
• place orders using a false identity or another person's payment method;
• interfere with the site's operation or place unreasonable load on our infrastructure; or
• use the site in a way that infringes another person's rights.
Unauthorised access to a computer system is an offence under Chapter 13 of ECTA and the Cybercrimes Act 19 of 2020. We will report suspected offences to the authorities.
13. PRIVACY AND YOUR PERSONAL INFORMATION
We process your personal information in accordance with POPIA. How we collect it, what we use it for, who we share it with, how long we keep it and the rights you have — including access, correction, deletion, objection and complaint to the Information Regulator — are set out in our Privacy Policy, which forms part of these Terms.
We send marketing email only where you have opted in, or where you are an existing customer and we are marketing similar products to you, as section 69 of POPIA permits. Every marketing message includes an unsubscribe link.
14. AVAILABILITY OF THE SITE
We work to keep this site available, but we do not guarantee uninterrupted access. The site may be unavailable during maintenance, upgrades, or as a result of load shedding, hosting failure or other events beyond our reasonable control. We may change, suspend or withdraw any part of the site without notice, and we are not liable for loss arising from unavailability.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by South African law:
• this site and its content are provided as is, and we give no warranty that the site will be error-free, uninterrupted or free of harmful components;
• we are not liable for indirect, incidental or consequential loss, loss of profit, loss of data, or loss arising from your use of or inability to use the site;
• where our liability for a claim relating to goods can lawfully be limited, it is limited to the amount you paid for the goods concerned; and
• we are not liable for delay or failure to perform caused by an event beyond our reasonable control, including load shedding, courier failure, fire, flood, strike, civil unrest, epidemic, or supplier or hosting failure.
[What we do not exclude]
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for harm caused by unsafe or defective goods under section 61 of the CPA, or for any other liability that South African law does not permit us to exclude. Where a court finds any limitation in this clause to be unfair, unreasonable or unjust under section 48 of the CPA, that limitation falls away and the rest of these Terms continue to apply.
16. INDEMNITY
You agree to indemnify Maison T. against reasonable claims, losses and legal costs arising from your breach of these Terms, your misuse of the site, your infringement of a third party's rights, or your failure to follow the candle safety instructions in clause 5. This indemnity does not apply to loss caused by our own negligence or breach.
17. LINKS TO OTHER WEBSITES
Our site may link to third-party websites, social media platforms or payment providers. We do not control them, we do not endorse their content, and we are not responsible for their terms, privacy practices or products. Please read their policies before you use them.
18. CHANGES TO THESE TERMS
We may amend these Terms from time to time to reflect changes in our business or in the law. The current version is always published on our website, with the effective date at the top. The version in force when you place an order is the version that governs that order — a later change cannot be applied retrospectively to a purchase you have already made. Please check the Terms each time you shop with us.
19. GENERAL
• Whole agreement. These Terms, together with our Refund & Returns Policy, Cancellation Policy, Delivery Policy and Privacy Policy, are the whole agreement between us in relation to your purchase.
• Severability. If any provision is found unlawful or unenforceable, it is severed and the remaining provisions continue in force.
• No waiver. If we do not enforce a right immediately, we do not waive it.
• Cession. You may not cede or assign your rights under these Terms without our written consent. We may cede our rights to a successor in the business, on notice to you.
• Electronic communication. You consent to receiving communications from us electronically. Data messages are deemed received as provided in section 23 of ECTA. Nothing in these Terms requires a communication to be in a form other than a data message.
• Plain language. These Terms are written in plain language as section 22 of the CPA requires. If anything is unclear, email us and we will explain it before you buy.
20. GOVERNING LAW, DISPUTES AND JURISDICTION
• These Terms are governed by the laws of the Republic of South Africa.
• Please contact us first — most disputes are resolved quickly and informally at info@maisontcandles.com.
• If we cannot resolve it, you may refer the matter at no cost to the Consumer Goods and Services Ombud (www.cgso.org.za), the National Consumer Commission, or — for a complaint about your personal information — the Information Regulator (www.inforegulator.org.za).
• You may also refer a dispute to an ordinary court. We consent to the jurisdiction of the Magistrate's Court having jurisdiction over you, even where the claim exceeds that court's normal limits, so that proceedings remain as affordable and accessible as possible for you.
• Nothing in this clause limits your right to approach any court, tribunal, ombud or regulator that has jurisdiction.
